    ..Overview of How TCR Auctions Work...

    .
    Bid Increments:
    • Minimum Bid Raise for Cattle priced on a per head basis: $25.00 per head
    • Minimum Bid Raise for Cattle priced on a per cwt. basis: 25 cents per cwt.


    There are 2 types of auctions:

    • Standard Auctions...
      • In a Standard Auction, no Bidder knows the identity of their competition during the auction, nor do they know the amount of the bids which other Registered Buyer(s) have placed during the auction. The only information available to a Bidder during an Auction is that Bidder's own current rank; i.e. first or fourth place at any given time and the Current High Bid Amount.
      • Seller is contractually obligated to sell the Sale Offering if the Winning Bid is equal to or greater than the Starting Price.  After the close of the auction, if the high bid is equal to or greater than the Starting Price, both Seller & Buyer will be notified and provided with contact information for the other party.
    • Reserve Price Auctions...
      • A Reseve Price Auction is the same as Standard Bid Auction with the exception that the seller has set a Reserve Price and the Starting Bid may be lower than the Reserve Price. In a Reserve Price Auction, the Seller places a Reserve Price, which may be a hidden amount, on the auction, and the Seller is not obligated to sell the Sale Offering unless the Winning Bid is equal to or greater than the Reserve Price.
      • A Reserve Price may be applied to any Standard Bid Auction. When utilized by the Seller, the Sale Offering Bid Form will indicate that a Reserve Price applies to that Auction and whether or not the Reserve Price has been "met".
      • Seller is contractually obligated to sell the Sale Offering if the Winning Bid is equal to or greater than the Reserve Price.  After the close of the auction, if the high bid is equal to or greater than the Reserve Price, both Seller & Buyer will be notified and provided with contact information for the other party.
    • Auctions will be previewed on both The Cattle Range & TCR On-Line Auctions for 5 days prior to the auction going “Live” i.e., open for bidding.
      • Auction listings will be indexed as a "Premium Listing" on the appropriate Breed(s) & Cattle Class pages The Cattle Range.
    • Auctions will be open for bidding for 84 hours, or 31/2 days, starting at 9:00 AM and closing 84 hours later at 9:00 PM. 
      • For example, an auction starting at 9:00 AM on Monday will close at 9:00 PM on Thursday, subject to the Extended Bidding Rule.
      • Auctions scheduled to close on Sunday evenings will be extended for an additional 24 hours and close on Monday evenings at 9:00 PM.
    • All Bids Are Limit Bids…
      • Each bid is accepted by TCR's system as a Limit Bid. (Also known as a “Proxy Bid”) When a Limit Bid is placed, the system only applies as much of the bid as necessary to satisfy the incremental increase and maintain the High Bid, and continues to bid on your behalf up to the maximum amount. A Buyer can always place higher bids, but a Buyer cannot place a Limit Bid for an amount lower than a previously placed Limit Bid.
      • For example, if you are willing to bid up to $1,500.00 per head on an auction for Bred Heifers with a Current High Bid of $1,250.00 per head, enter your Limit Bid for $1,500.00. The system will enter your bid as $1,275.00 and you are now the High Bidder at $1,275.00 per head. If a subsequent bid is placed for $1,300.00, the bidder will instantly be notified they have been outbid, at which point your bid is now $1,300.00. 
      • You remain the high bidder unless a bid of $1,525.00 is received. At that point, you have the option of submitting a new Limit Bid in excess of $1,525.00.  In this example, if your Limit Bid is raised to $1,450.00 and a higher bid is not received, your bid is the Winning Bid at $1,450.00 per head.
      • In in Reserve Price Auction, a limit bid that exceeds the Reserve Price will automatically be entered as the amount of the Reserve Price and not the next incremental bid above the Current High Bid.
    • Unless otherwise agreed, buyers do not have to accept unmerchantable livestock.  This includes, but is not limited to cripples, bad eyes, lumps, chronics, quinines, locos, and sick animals.

    ..Auction Fee Schedule...

    • There is a $75.00 Auction Administration Fee which includes indexing as a "Premium Listing" on both The Cattle Range main site & TCR Auction site.
    • A schedule of sale fees, for both Standard Auction Sellers on which the high bid is equal to or greater than the Starting Price and Reserve Price Auction Sellers on which the high bid is equal to or greater than the Reserve Price, is shown below.
    • No Sale Fee is payable if the high bid is not equal to or greater than the Starting Price in a Standard Auction or if the high bid is not equal to or greater than the Reserve Price in a Reserve Price Auction.

    ..Auction Guidelines & Defintions...
    .
    To assist both Buyers & Sellers, The Cattle Range, hereinafter referred to as TCR, is providing you definitions to some common terms seen on the bid form and in Auction descriptions, as well as guidelines & policies that explain and govern the auction process:
    • Auction Payment: The amount of the Payment to be made by the Successful Bidder for the Sale Offering.
    • Auction Types: TCR offers Standard Auctions & Reserve Price Auctions.
    • AutoNotify: A feature located in the My Account section of TCR's Auction site where a Registered Buyer may request to be notified via email of any new auction postings.
    • Bid History: Link to the page on the website that is known as the Bid History Page. On the Bid History Page, the Bidder may review his placement during the auction. After the auction, the Top 3 Bidder's may access detailed information concerning the auction results; i.e. Top 3 Bidder's Identities, rank, and final bid amounts.
    • Bidholder: Also known as Current Bidholder; See Below for definition. 
    • Bid Increments: (Also referred to as "Minimum Bid Increment") Bids will be raised in increments based on how the cattle are offered for sale...
      • Bid Increment for cattle priced on a per head basis: $25.00 per head - For example, bulls, cows, bred heifers, etc.
      • Bid Increment for cattle priced on a per cwt. basis: 25 cents per cwt. - For example, stocker calves or feeder cattle.
    • Bid Retraction: A Bid is not retractable except under circumstances deemed appropriate by TCR. Such circumstances may include, but are not limited to...
      • Seller's later material and significant change to the description of the Sale Offering which was unknown or unforeseen at the time of posting;
      • A material and significant descriptive or typographical error with respect to the Sale Offering;
      • The later addition of a term or condition not presented in the original posting;
      • Each Registered Buyer is responsible for any Limit Bid which they place;
      • A Bidder can always place higher bids, but a Bidder cannot place a Limit Bid for an amount lower than their own previously placed Limit Bid. 
    • Buyer or Registered Buyer: A prospective Buyer that (a) registers with TCR and (b) receives acceptance of such registration by TCR. 
    • Closed Auction: Any auction in which the time limit has expired for receiving new bids. A Closed Auction includes both auctions which have expired at the Auction Closing and auctions which have expired in accordance with the Extended Bidding Rule. 
    • Completed Auction: Any auction which results in a "Winning Bid" at the Auction Closing. 
    • Current Bid: A Registered Buyer's bid amount as of the current time and date on a Sale Offering. 
    • Current Bid Rank: A Registered Buyer's rank at the current date and time of an open or closed auction. This information is accessed in the Bid History section of the Sale Offering. 
    • Current Bidholder: The Registered Buyer who has placed a bid on a Sale Offering and holds the Current High Bid for that Sale Offering with that bid.
    • Current High Bid: The highest bid as of the current time and date on a Sale Offering during an auction. 
    • Extended Bidding Rule: TCR has an Extended Bidding Rule which can vary from one to five minutes in order to prevent excessive last minute Bidders from "stealing" or "sniping" a Sale Offering. 
      • If a bid is placed within the specified Extended Bidding Time Period of the Auction Closing, such Auction Closing will automatically be extended for the Extended Bidding Time Period to allow other Bidders the opportunity to re-bid and exceed the Current Bid;
      • If another bid is received within the Extended Bidding Time Period of such bid, the Auction Closing is further extended for an additional time period in the amount of the Extended Bidding Time Period;
      • This process continues until the specified Extended Bidding Time Period expires with no additional bid being placed on the Sale Offering, at which time the actual Auction Closing occurs;
      • Please note that only the Top 3 Bidders as ranked at the originally scheduled Sale Offering Closing Time can participate in Extended Bidding past the Sale Offering Closing Time. Back to Overview
    • Limit Bid: (Also known as a “Proxy Bid”) Each bid is accepted by TCR's system as a Limit Bid. When a Limit Bid is placed the system only applies as much of the bid as necessary to satisfy the incremental increase and maintain the High Bid, and continues to bid on your behalf up to the maximum amount.  A Buyer can always place higher bids, but a Buyer cannot place a Limit Bid for an amount lower than a previously placed Limit Bid.
    • MinBid: This is the Minimum Bid needed to open bidding on a Sale Offering. Also, see Starting Bid definition.
    • Minimum Raise: The amount by which a bid must exceed the Current High Bid. See Bid Increment as defined above.
    • Proxy Bid: (Also known as a “Limit Bid”) Each bid is accepted by TCR's system as a Limit Bid. When a Limit Bid is placed the system only applies as much of the bid as necessary to satisfy the incremental increase and maintain the High Bid, and continues to bid on your behalf up to the maximum amount.  A Buyer can always place higher bids, but a Buyer cannot place a Limit Bid for an amount lower than a previously placed Proxy Bid.
    • Registered User: A Registered Seller or a Registered Buyer. 
    • Reserve Auction: Also known as Reserve Price Auction; see definition below. 
    • Reserve Price: The amount for which the Seller is obligated to sell the Sale Offering in a Reserve Auction. This amount may be hidden. 
    • Reserve Price Auction: A Standard Bid Auction which has a Reserve Price. A Seller may also require a Starting Bid that is lower than the Reserve Price. In a Reserve Price Auction, the Seller places a Reserve Price, which may be a hidden amount, on the auction, and the Seller is not obligated to sell the Sale Offering unless the Winning Bid is equal to or greater than the Reserve Price. A Reserve Price may be applied to any Standard Bid Auction. When utilized by the Seller, the Sale Offering Bid Form will indicate that a Reserve Price applies to that Auction and whether or not the Reserve Price has been "met".
    • Right of Refusal: Seller's right to refuse sale of a Sale Offering in a Standard Auction with Reserve Price. This right exists for every Standard Bid Auction where the Reserve Price has not been met or exceeded by a Limit Bid placed by a Registered Buyer.
    • Sale Offering: The cattle offered for sale, whether 1 head or more.
    • Seller or Registered Seller: A prospective Seller that (a) registers with TCR and (b) receives acceptance of such registration by TCR. 
    • Starting Bid: The minimum bid that a Seller may require to open bidding on an Sale Offering. There may or may not be a Starting Bid in an auction. If the auction is a Reserve Price Auction, the Starting Bid is not the Reserve Price.
    • Standard Auction: The format in which each Auction is conducted. No Bidder knows the identity of their competition during the auction, nor do they know the amount of the bids in which other Registered Buyer(s) have placed during the auction. The only information available to a Bidder during an Auction is that Bidder's own current rank; i.e. first or fourth place at any given time and the Current High Bid Amount. 
    • Subject to Prior Sale: TCR does not allow any items to be posted under these terms. Any Sale Offering on TCR by Sellers are available and are not subject to prior sale. If a Bidder places a Winning Bid, then that Bidder has a legal contract for that Sale Offering. 
    • Successful Bidder: The Registered Buyer that places the Winning Bid in an auction. 
    • Watch List: A Buyer may save time searching for that Buyer's favorite open auctions by adding them to a Watch List. When a Buyer returns to the My Account section of the TCR auction site that Buyer will be able to view on one screen the progress of all the auctions added to the Watch List. To select this feature on the bid form, simply click the Add to Watch List graphic. 
    • Winning Bid: The highest bid in a Standard Bid Auction, or the highest bid in a Reserve Auction that meets or exceeds the Reserve Price; provided, however that in the event two or more Buyers tie for the highest bid, the Winning Bid shall be awarded to the Buyer who first placed the highest bid with TCR. 
    • 5 Minute Rule: See Extended Bidding Rule definition above.

    ..Other Terms & Conditions...

    By using The Cattle Range On-Line Cattle Auction Services, hereinafter referred to as TCR, you agree to comply with the "Terms & Conditions" found below and any and all state, federal or international laws that apply. In addition, you agree to use the system at your own risk and pursuant to the following terms: 
    • TCR reserves the right to refuse the right to use the auction system and services to anyone at any time for any reason or no reason at its sole discretion.
    • TCR acts only as a venue and is neither responsible for nor involved with any details of a transaction between a Buyer and Seller.
    • TCR shall be held harmless by any user who may experience problems, loss or damage arising or originating from use of the auction system and service.
    • TCR is not responsible for any problems, damage or loss caused by circumstances out of our control. This includes, but is not limited to, system failures, system errors, internet related problems, power outages, fire and theft. 
    • TCR cannot and does not guarantee that any Seller or Buyer will complete the sale of, or consummate the purchase of, any Auction Item. All risk of the same is assumed by each individual Buyer and Seller and includes, but is not limited to, risks associated with dealing with foreign nationals, underage persons, or persons acting under false pretense.
    • TCR reserves the right to omit, remove, or re-categorize, at any time, any listing at its sole discretion.
    • TCR does not guarantee the receipt of e-mail associated with invoicing, bidding updates, and winning bid notices by any Registered User of the auction system. 
    • TCR strictly prohibits any Seller from bidding on his/her own listing or using any other third party, sham or shill bidding. 
    • TCR disclaims any expressed or implied warranties and/or guarantees and assumes no responsibility for the quality, worth, or merchantability of any cattle listed. Any Buyer's recourse lies with the Seller of the cattle. 
    • TCR is not responsible for and assumes NO risk or liability associated with the sale or potential sale of any listing. 
    • TCR denies and disclaims any implied warranty of merchantability. 
    • TCR strictly prohibits any inappropriate use of the system. However, TCR cannot and does not guarantee that inappropriate use of the system will not occur. This includes, but is not limited to, any inaccurate, incorrect, erroneous, untrue or fallacious information submitted for auction listings or user registration. 
    • TCR requires each Registered User to be of legal age in any and all jurisdiction that may apply to any transaction.
    • Sellers are responsible for confirming that correct photos and information are appearing on their listings and to advise TCR of errors and the corresponding corrections needed. TCR is not responsible for unreported incorrect listing information, typos, or accidental errors appearing on listings. 
    • Contact information is displayed on your listing.  TCR is not responsible for any misuse of this information.
    • TCR does not guarantee any of the livestock listed on this site. The buyer is responsible for ensuring the validity of all information about livestock.
    • Unless otherwise agreed, buyers do not have to accept unmerchantable livestock.  This includes, but is not limited to cripples, bad eyes, lumps, chronics, quinines, locos, and sick animals. 
    • Information such as photos and logos are easily downloaded from the Internet.  TCR is not responsible for any copyright, trademark, trade name, patent, or any other content, that is downloaded from our website and utilized in violation of local, state or federal laws.
    • By participating in the services provided by TCR, all users, sellers, and buyers, agree to the above terms and conditions in their entirety.
